Redefining Artificial Intelligence

How intellectual property practitioners view the coming wave of artificial intelligence, from benefits and barriers to responsible AI.

The guardians of the IP practice

The interplay between IP, AI and the wider legal industry is complex.

While AI is well-suited for the legal sector, it is also challenging to piece together. IP and AI have something in common: intellect. At the most basic level, IP captures and rewards intellect; AI attempts to emulate it.

How intellectual property creators, owners and protectors see AI is important. These perceptions shape the development of AI-based technology. IP practitioners are not passive recipients of information. They are the coarchitects, pioneers and careful stewards of the future state of the profession.

Benefits, risks and adoption

Perceptions of AI invariably shape how it can be used. Surveying stakeholders across the IP ecosystem suggests a prevailing discomfort towards adopting AI technologies.

While the potential applications for AI are vast, IP professionals are currently focused on incorporating AI into low-risk, automatable tasks that are heavily supervised. Across the board, the least desired AI use case was for IP prosecution and PTO interaction.

43%
of respondents do not currently incorporate AI into their IP processes
67%
of respondents are most excited about adopting AI for automating manual tasks
55%
of attorneys want AI applied to trademark availability research
74%
of respondents identified accuracy as their biggest concern when adopting AI

Laying the foundation for AI in IP

Creators of AI systems seek to emulate and model human intelligence. Yet, trying to simulate human reasoning is complex. Intelligence is highly contextual, and expert knowledge is tacit and difficult to capture.

Advancements in AI bring about significant changes and improvements to the delivery of IP services:
